The nonimmigrant visas range from A to V. Some of the more common work visas are: E-1/E-2 Treaty Trader/Treaty Investor, L-1 Intracompany Transferee, O Extraordinary Ability, P Athletes and Entertainers, R Religious Worker, and TN Trade NAFTA. Many foreign nationals who work in nonimmigrant status can remain in the US by applying for legal permanent residence through work.

Family-based visas tend to fall more in the immigrant category, with the most common being the Immediate Relative. Immediate Relatives are those foreign nationals who are the spouse or child of a US citizen. The K nonimmigrant visa is for fiancées. Widows of US citizens and foreign nationals who have been battered by a US citizen spouse can also self-petition through the I-360 process.

US citizenship tends to fall into two main areas: (1) legal permanent residents who are able to naturalize to become a US citizen and (2) children born to US citizens who may need to go through more of a process than just applying for a US passport.

US immigration is a complex area of law. The above is only a very brief explanation. Many people tend to think that their case may be very similar to a friend’s, however one small fact can make a big difference in whether a case will be approved or not.
